Terms of Service

Effective Date: March 30, 2026

These Terms of Service ("Terms") govern your use of Diaryx, including the web application at app.diaryx.org, the desktop and mobile applications, the CLI, and any associated services (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Description of Service

Diaryx is a note-taking and journaling application. The Service includes:

  • A local-first editor for creating and organizing notes
  • Optional cloud sync to keep notes synchronized across devices
  • Optional website publishing to share notes publicly
  • Optional plugins for AI, sharing, and other features

2. Accounts

To use cloud features (sync, publishing, AI), you must create an account by providing a valid email address. You are responsible for maintaining the security of your account.

3. Subscription Plans

Free Plan

The Free plan includes one synced workspace on up to two devices and one published website.

Plus Plan

The Plus plan costs $5/month (USD) and includes:

  • Sync for up to 10 workspaces
  • Live editing sessions with up to 5 collaborators
  • AI features
  • 2 GiB attachment storage

Plus subscriptions auto-renew monthly. You may cancel at any time:

  • Stripe (web/desktop): Via the Manage Billing page in Settings.
  • Apple In-App Purchase (iOS/macOS): Via Settings > Apple ID > Subscriptions on your device.

Upon cancellation, your Plus features remain active until the end of the current billing period.

4. Your Content

You retain all rights to the content you create with Diaryx. We do not claim ownership of your notes, entries, or attachments.

When you use cloud sync, your content is stored on our servers to provide the sync service. When you publish content, it is made available at the audience level you choose (public, token-protected, or private).

5. Acceptable Use

You agree not to:

  • Use the Service to store or distribute illegal content
  • Attempt to interfere with or disrupt the Service
  • Use the Service to send spam or unsolicited messages
  • Reverse-engineer the Service beyond what is permitted by applicable law
  • Exceed reasonable usage limits or abuse the Service infrastructure

6. Intellectual Property

The Diaryx software is licensed under the PolyForm Shield License 1.0.0. The source code is available at https://github.com/diaryx-org/diaryx. Your use of the software is subject to that license.

7. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, with notice when practicable.

Upon termination, your synced data may be deleted from our servers. Local data on your devices is not affected.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that your data will never be lost.

You are responsible for maintaining local backups of your data.

9. Limitation of Liability

To the maximum extent permitted by law, Diaryx and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.
